Sidekick Dating App Privacy Policy

Sidekick Dating, Inc. a company incorporated in Delaware, whose registered address is 3500 South DuPont Highway, Suite FF-101, Dover, DE, 19901, USA (“Sidekick, or “we” or “us”), respects the privacy of individuals and seeks to minimize the amount and types of personally identifiable information we collect. When you use the Sidekick Dating application (the “App”) we do not collect your name, address, email address or phone number. We are providing this Privacy Policy to inform App users of the types of data we do collect in relation to their use of the App and how we use and maintain that information. By using the App, you are deemed to agree to the terms of this Privacy Policy, so please do not use the App if you do not agree with these terms.
We may update this Policy at any time. Any changes to the Policy will become effective upon the date of our posting of the revised Policy on our website, Sidekick Dating | Dating you can trust. If we make material changes to the Policy, we will also inform our users via a notice on the App. If you use the App following the effective date of the revised Policy, you will be deemed to have accepted the Policy’s updated terms.
1. What Information Does Sidekick Dating Collect from You as an App User?
The information you provide about yourself in order to use the App is generally not collected by Sidekick but rather stored on the mobile device you use to connect to the App. The Sidekick account you create will be maintained within your own device and we will not have access to it. When you upload your profile, photos, etc. to your account, that information will be visible to other App users, but not to Sidekick. If you lose your device, you will lose access to the information in your account, as Sidekick will not maintain it.
Each device that launches Sidekick for the first time generates a unique Sidekick Dating identification code (“SKDID”) which is uploaded to the Sidekick server. The SKDID is created as a very large, random number, and assigned to that specific device, thus generating a new user ID specific to Sidekick, without gathering any other information about the user of the device. The Sidekick server stores the SKDID and retains it until the device user deletes the App.
When a user is active on the App, their device IP (Internet Protocol) address is actively updated in the remote Sidekick database. The SKDID and a “findback” code, which is a separate, randomly generated code assigned to the device, are stored on the Sidekick server. The only associations the server makes with each user’s SKDID are (a) the encryption keys used to communicate with that individual device, (b) the longitude and latitude of the last known location of the device, (c) the unique findback code, and (d) a temporary storage of the device’s last known IP and Port Address, which is usually wiped in about 10 minutes.
When a Sidekick user creates a dating preferences profile, the following “General Selection Bits” are uploaded to the Sidekick server (but not permanently stored) to help the user find a potential partner: (a) the “Fling or Flame” preference of the user, (b) the last known GPS co-ordinates of the user, (c) the gender identification of the user, (d) the job status of the user, (e) the sought radius of potential partners of the user, (f) the sought gender preference of potential partners of the user, (g) the sought job status of potential partners of the user. In order to connect App users to one another, a user’s profile and dating preferences may be stored on the server temporarily — but solely in encrypted form — so that it can be held for forwarding to other users (as requested by the initiating user) when they activate the App. There is no interface in the server code that would allow Sidekick to access this data in unencrypted form.
2. How Does Sidekick Use the Information It Collects from You?
As indicated above, Sidekick uses the information it collects from you when you use the App, as described above (“User Information”), to facilitate your connecting with other users as potential partners. We use the manufacturer unique ID on the device you use to download and use the app to create the SKDID and findback code so that we can enable your device to use the App. In other words, we use your User Information to make the App work for you and other App users.
3. With Whom Do We Share the Information We Collect About You?
We may share User Information that does not identify you personally for any legitimate purpose. However, Sidekick shares User Information in very limited circumstances, as follows:
a. Operational Partners and Third-Party Service Providers. We share User Information with unaffiliated third parties who provide us with services, such as the Apple App Store. We do not share User Information with unaffiliated third parties for their own marketing purposes.
b. Acquirers or Assignees. In the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Sidekick or its assets, we may transfer any and all User Information to the proposed or actual acquiring party or assignee.
c. Entities Entitled Under Law. We may disclose User Information as we believe to be appropriate in the following circumstances: (i) when required by applicable law, including laws outside your country of residence; (ii) to comply with legal process (iii) to respond to requests from public and government authorities; (iv) to enforce the terms and conditions for use of the App, including this Policy; (v) to protect and defend our rights and property; (vi) to protect the interests of Sidekick or others; and (vii) to permit us to pursue available remedies or limit the damages that we may sustain. We have no obligation to notify you of such disclosures, except as required by applicable law.
4. Data Security. We use reasonable organizational, technical and administrative measures to help protect against the loss, misuse and alteration of the information under our control, including encryption and Secure Socket Layer (SSL) certificates. However, no data transmission over the Internet or data storage system can be guaranteed to be 100 percent secure.
5. Use of the App by Minors. Our App is not intended for use by minors, and we do not knowingly collect any information from or about minors. If we were to discover that we had collected any personally identifiable information from a minor, we would promptly delete it.
6. For Users in the United Kingdom
Users of our App who are located in the United Kingdom may have rights under the UK General Data Protection Regulation (‘UK GDPR’), including the following:
a. The right to request from us access to, updating of, or erasure of your personal data, as well as the right to request limitations on our processing of personal data concerning you, to object to our processing of your personal data, and the right to data portability.
b. Where our processing of your personal data is based on consent, you have the right to withdraw your consent at any time.
c. If you are unhappy with the way Sidekick has processed your personal data, you may raise a complaint with the UK supervisory authority (which is the Information Commissioner’s Office).
For the purposes of the UK GDPR, the lawful basis we rely upon is “legitimate interests,” as Sidekick has a legitimate interest in providing services to its customers in the course of running its business.

7. International Transfers of Information. By using the App, you are deemed to understand and unambiguously consent to the collection and processing of your User Information in the United States, with the awareness that the laws of the United States may not provide as much protection for such information as the laws of certain other countries or territories.
